1. Agreement
These Terms of Service ("Terms") govern your use of faicomm.com (the "Site") operated by Falcomm, Inc. ("the Company," "we," "us," or "our"), a Maryland corporation with offices at 1100 Wicomico Street, Suite 320, Baltimore, MD 21201. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
The Site is a B2B technical resource for hardware engineers and procurement professionals evaluating RF power amplifier products. The materials available through the Site -- including datasheets, application notes, and technical specifications for the FA-2400 series -- are intended for professional use by individuals with the technical expertise to evaluate and apply RF semiconductor components safely and in accordance with applicable law.
2. Use of the Site
- You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the Site.
- You agree not to use the Site for unlawful purposes, to interfere with Site operation, or to attempt to gain unauthorized access to systems or data, including the customer portal.
- You may not scrape, reverse-engineer, or copy Site content except as permitted by applicable law or with our prior written permission.
- Access to certain materials through the customer portal is conditioned on registration and approval. Credentials are personal and may not be shared.
- You are responsible for maintaining the confidentiality of your portal account credentials and for all activity under your account.
3. Intellectual Property
The Site, including all text, graphics, logos, technical diagrams, product specifications, and software, is owned by Falcomm, Inc. or its licensors and is protected by US and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access the Site and its publicly available content for the purpose of evaluating Falcomm products for potential procurement. Materials accessed through the customer portal (including datasheets and SPICE models) may carry additional licensing terms specific to those materials; those terms govern in the event of any conflict with these Terms.
4. User Content and Submissions
You are responsible for any content you submit through the Site, including information submitted via the datasheet request form, contact form, or email. You represent that you have all necessary rights to submit such content and that it is accurate to the best of your knowledge. You grant the Company a limited license to use, store, and process the content as necessary to respond to your inquiry, fulfill your request, and provide the Site. We handle submitted information in accordance with our Privacy Policy.
5. Technical Information; No Reliance
Falcomm publishes technical specifications, application notes, and product data in good faith based on characterization results. This information is provided for reference and design guidance only. Falcomm makes no warranty that any product will meet your specific system requirements. You are responsible for independently verifying the suitability of any Falcomm product for your application before design-in or production use. Nothing in Site materials constitutes a binding product specification unless separately confirmed in a written quotation or purchase agreement.
6. Export Controls
Falcomm products and associated technical data may be subject to applicable US export control laws and regulations. By accessing technical documentation or requesting evaluation samples, you represent that you are not located in, under the control of, or a national of any country subject to a US government embargo, and that you are not listed on any US government restricted-party list. Access to certain technical materials may be conditioned on export-control screening. You are solely responsible for compliance with all applicable export control requirements in your jurisdiction.
7. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FALCOMM, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FALCOMM DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FALCOMM, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED USD $100.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, our liability will be limited to the maximum extent permitted by applicable law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Falcomm, Inc. from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any third-party right, including any intellectual property or export-control obligation.
10. Termination
We may suspend or terminate your access to the Site or the customer portal at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive, including Sections 3, 5, 6, 7, 8, 9, 11, and 12.
11. Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law principles.
Informal Resolution. Before filing a claim, you agree to contact us at [email protected] and attempt informal resolution for at least 60 days.
Arbitration. Any dispute that cannot be resolved informally will be settled by binding arbitration administered in Maryland, USA under the rules of the American Arbitration Association ("AAA"). Judgment on the arbitrator's award may be entered in any court of competent jurisdiction. You and Falcomm, Inc. each waive the right to a jury trial and the right to participate in a class action.
Exception. Either party may seek injunctive relief in a court of competent jurisdiction located in Maryland, USA for intellectual property infringement or unauthorized access to the Site or customer portal.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted with a new effective date. Continued use of the Site after the effective date of updated Terms constitutes acceptance of those Terms.
